CDM does not apply to:
- <30 days construction (not demolition) and <4 people
- Domestic projects although designers duties still apply
- Construction work carried out in offices or shops that does not effect the operation
- Maintenance or removal of insulation of pipes unless as part of a larger scheme
CDM applies to everything else so an F10 form will need to be submitted to the HSE
Who is the designer?
Individuals who carry out design work for construction drawings / design details / specification / bill of quantities etc.
Designers duties:
- Make the client aware of their duties
- Give due regards to H&S in their design work
- Provide adequate information about H&S risk of the design to those who need it
- Coordinate with the planning supervisor (the H&S coordinator) and where appropriate other designers
Clients duties:
- appoint a planning supervisor
- provide information to the planning supervisor
- appoint a principle contractor
- ensure those you appoint are competent and adequately resourced to carry out their H&S responsibilities
- ensure that a suitable H&S plan has been prepared by the contractor before construction starts
- ensure that the H&S file is given to you at the end of the project

Agent for client:
Written declaration to HSE station:
- Explain the agent is working on your behalf
- Name and address of agent
- Exact address of the site
- Be signed by or on behalf of your agent
Role of Planning Supervisor (from 2006 H&S Coordinator)
- Coordinating the H&S aspects of the design
- Pre-tender H&S plan
- Ensure the H&S file is prepared
- HSE notification
- Cooperation between designers
- Ensure designer comply
- Advise client

Boff:
6 April 2007 new CDM regs come into force. They are simplified and marry the CDM 1994 regs with the Construction (H&S and welfare)1996 into a single package. An approved code of Practice (ACoP) will be issued in Jan 2007
